Procurement at the Banco de España conforms to the principles of freedom of access to tenders, publicity and transparency of procedures, non-discrimination among and equal treatment of candidates, and efficient use of resources earmarked to undertake works, the acquisition of goods and the contracting of services, by requiring the prior definition of the needs to be satisfied, the safeguarding of freedom of competition and the selection of the most economically advantageous tender.
Currently, the contractual activity of the Banco de España is governed by Law 9/2017 of November 8 on public sector contracts (LPSC, for its initials in Spanish, available only in Spanish) and its implementing rules, applicable to contracting authorities deemed not to be Public Administration as defined in the LPSC and provided that those provisions do not affect the autonomy of the Banco de España. The organisational and internal aspects that affect the procurement at the Banco de España are regulated by Internal Circular 4/2022 of June 20 (146 KB) (available only in Spanish).
Furthermore, the Banco de España may participate in the joint tender procedures that take place within the framework of the Eurosystem Procurement Coordination Office (EPCO). These procedures are governed by the provisions of the Decision of the European Central Bank of 17 November 2008 laying down the framework for joint Eurosystem procurement (Decision ECB/2008/17)
