Legal framework

The Banco de España is a public law entity with its own legal personality and full capacity to act publicly and privately. To fulfil its functions, in the course of its activities it acts independently of the central government and performs its duties in accordance with the Law of Autonomy and other legal requirements.

Also, as part of the European System of Central Banks (ESCB), the Banco de España is subject to the provisions of the Treaty on European Union and the Statute of the ESCB.
