Management assignment and Concession contracts

Management assignment is a legal instrument through which administrative bodies or public law entities may entrust other bodies or public law entities, in the same or a different agency, with the performance of activities of a material or technical nature, for reasons of efficiency or when they do not have the appropriate technical means to perform such tasks themselves. Management assignment is regulated in Article 11 of Law 40/2015 of 1 October 2015 on the Legal Regime of the Public SectorOpens in new window (in Spanish).

Banco de España publishes information related to the management assignments that are in force, indicating their purpose, duration, and economic obligations. Currently, Banco de España does not have management contracts signed.

Concession contracts are regulated in Public Sector Contracts Law 9/2017 of 8 November 2017,Opens in new window which transposes into Spanish law Directives of the European Parliament and of the Council 2014/23/EU and 2014/24/EU of 26 February 2014, in Article 32 and in the twenty-fourth additional provision.These contracts are the formula through which the contracting authorities may entrust the execution of the services inherent in contracts for works, supplies, services, works concessions and service concessions to another private or public law legal entity, provided that the latter has legal status as an economic operator at the service of the public administration.
