Purpose
Provide information on the shareholding composition of corporate companies, potential plaintiffs through ongoing legal proceedings, as well as parties affected by insolvency proceedings with the aim of making accurate assessments of the borrowers of credit institutions
Legal basis
Performance of a task carried out in the public interest or in the exercise of official authority vested in the controller pursuant to Law 10/2014, of 26 June, on management, supervision and solvency of credit institutions.
Categories of data subjects
- Shareholders of commercial companies registered in Spain
- Plaintiffs of these companies in legal proceedings against them
- Affected by insolvency proceedings on these companies
Categories of personal data
- Identification data: Name, surname, ID number
- Economic data: Share of ownership in capital’s company, contested sum, court and case number
- Professional data: ID number and name of the company (participated, defendant of affected by an insolvency proceeding)
Retention period
Personal data shall be retained for the time necessary to fulfil the purpose for which they were collected and to allocate any liability arising from said purpose and from the processing of the data.
Security measures
Security measures provided for in Annex II of Royal Decree 3/2020, of 8 January, which regulates the National Security Scheme in the field of Electronic Administration.
