Communication gateway with the Deposits Guarantee Fund (FGD)

Purpose

  • Reception and communication to the Deposit Guarantee Fund (FGD) of the information on deposits provided in Annex 2 of Circular 8/2015 sent by the entities and branches affiliated with the FGD, through the infrastructure of the Banco de España, for the exercise of the functions of the FGD

Legal basis

Compliance with a mission carried out in the public interest (article 6.1.e) of the RGPD), provided for in the following regulations:

  • Royal Decree-Law 16/2011, of October 14, which creates the Deposit Guarantee Fund for Credit Institutions.
  • Royal Decree 2606/1996, of December 20, on deposit guarantee funds of credit institutions.
  • Ministerial Order of March 31, 1989, which empowers the Bank of Spain to establish and modify the accounting standards of credit institutions

Categories of data subjects

  • Holders of deposits received by the entities and branches affiliated with the FGD

Categories of personal data

  • Identification data: Name, surname, NIF
  • Contact details: Postal address, including province, town, and postal code
  • Economic and financial data: Type, amount, specially protected amount, entity, guarantee, currency, code, maturity date, number of holders of each deposit
  • Data of minors under 14 years old
  • Others: Remaining data provided in Annex 2 of Circular 8/2015

Retention period

The Banco de España, acting as the processor for the FGD for this processing, will handle personal data following the instructions set out in the collaboration agreement signed between the Banco de España and the FGD for the communication of information on deposits from entities and branches affiliated with the FGD (the Collaboration Agreement).

Regarding data retention periods, the Collaboration Agreement establishes that the Banco de España will delete the processed data after its communication to the FGD, unless otherwise instructed by the FGD or if its retention is required under Union or Member State law.

Security measures

In accordance with the First Additional Provision of the Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights, the security measures implemented at Banco de España correspond to those provided for in the National Security Scheme.

  • Providers of Banco de España who need to access the data to fulfill the obligations set out in the Collaboration Agreement

International transfer of data

International transfers of the processed data are not planned.
