Supervision regarding reservation of activity and denomination

Purpose

  • Supervision of individuals or legal entities that, although not registered with the Bank of Spain, carry out reserved activities or use reserved names.

Legal basis

Performance of a task carried out in the public interest or in the exercise of official authority vested in the controller pursuant to:

  • Article 7.6 of Law 13/1994, of 1 June, on the Autonomy of Banco de España.
  • Fourth Additional Provision of Law 10/2014, of 26 June, on management, supervision and solvency of credit institutions

Categories of data subjects

  • Individuals under investigation and, if applicable, their legal representatives.
  • Individuals reporting information (whistleblowers and others) and, if applicable, their legal representatives.

Categories of personal data

  • Identification data: Name, surname(s) and ID number
  • Contact details: postal address, e-mail address, telephone number
  • Academic and professional data: Background, labor position, etc.
  • Economic and financial data: Salary, accounts, transactions, financial information such as credit risk reports, etc.

Retention period

Personal data shall be retained for the time necessary to fulfil the purpose for which they were collected and to allocate any liability arising from said purpose and from the processing of the data.

Security measures

In accordance with the First Additional Provision of the Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights, the security measures implemented at Banco de España correspond to those provided for in the National Security Scheme.
