Purpose

  • Management of staff recruiting activities
  • Management of the awarding of grants or study aids

Legal basis

  • Consent of the data subject for using data subject’s data for other recruitment process.
  • Performance of pre-contractual measures requested by the data subject.
  • Compliance with a legal obligation, provided for in:
    • (i) Royal Decree 901/2020, of 13 October, which regulates equality plans and their registration and amends Royal Decree 713/2010, of 28 May, with regard to gender as a category of data requested from candidates in selection processes.
    • (ii) Law 39/2015, of 1 October, on the Common Administrative Procedure for Public Administrations, with regard to external selection processes. 
    • (iii) Royal Legislative Decree 1/2013, of 29 November, approving the Consolidated Text of the General Law on the Rights of Persons with Disabilities and their Social Inclusion, with regard to quotas for persons with disabilities.
    • (iv) Law 30/1984, of 2 August, on Measures for the Reform of the Civil Service, with regard to the adaptation of selection tests for persons with disabilities.
  • Fulfilment of a public interest mission in relation to the processing of data relating to the commission of criminal offences (possible disciplinary sanctions and disqualification from public employment that selected candidates confirm in the affidavit that they are required to provide prior incorporation), as provided for in:
    • (i) Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (Twelfth Additional Provision).

Categories of data subjects

  • Permanent or temporary job applicants
  • Students applying for a traineeship (internships, financial aid for study)

Categories of personal data

  • Identification data: Name, surname, NIF or equivalent.
  • Contact details: Telephone number, e-mail, postal address.
  • Academic and professional data: Training, qualifications, positions held, job evaluations, employee number and Social Security number.
  • Economic and financial data: Account number and transaction relating to the payment of fees for participation in selection processes for permanent employment.
  • Personal characteristics data: Nationality, date of birth, sex, image.
  • Data relating to the commission of criminal offences: Affidavit linked to the disqualification for public employment requested in the rules of the selection processes exclusively with regard to those candidates who passed these processes in order to manage their incorporation.
  • Special category data: Health data relating to the disability of those job applicants who request (i) the adaptation of their tests and/or (ii) to participate in processes that have a quota for people with disabilities, whose processing is necessary for reasons of essential public interest regulated in the General Law on the rights of people with disabilities and their social inclusion and in Law 30/1984, of 2 August, on Measures for the Reform of the Civil Service (article 9.2.g) of the RGPD).

Retention period

Personal data shall be retained for the time necessary to fulfil the purpose for which they were collected and to allocate any liability arising from said purpose and from the processing of the data

Security measures

Security measures provided for in Annex II of Royal Decree 3/2020, of 8 January, which regulates the National Security Scheme in the field of Electronic Administration

  • Interested candidates participating in the process, who have the right to see the lists of results by name
  • Judges and Courts
  • Other competent bodies of the Public Administration
