On 29 April 2012, Orden EHA/2899/2011, de 28 de octubre
, on bank services transparency and customer protection (Official Spanish Gazette (BOE) of 29 April) took effect, except for part of Title III, concretely its Chapter II –exempting section 3rd- which will take effect on 29 July.
With the this Order taking effect, which repeals the Ministerial Order of 12 December 1989, entities are no longer obligated to prepare a brochure with the fees, conditions and expenses charged to customers and register it with Banco de España, although it is not descartable for entities to maintain those brochures freely, indicating that the fees specified therein are the maximum or a value for information purposes only.
Because this obligation ceases to exist, Banco de España has removed the publication of entity fee brochures from these pages.
The new Order establishes the obligation that entities provide non-business customers with the interest rates and fees regularly applied to the services they provide most often, in the manner and according to the terms to be established by a future Circular from Banco de España, which is currently in the public consultation phase.
This information will be added to these Banco de España pages on the internet, as soon as technically possible, in a format that enables sharing among entities.
Although the new Banco de España Circular has not yet taken effect, that does not lessen the rights of customers in any way to obtain all pre-contractual information on interest rates and fees from the entities, as well as to receive adequate and sufficient explanations in the terms set forth in articles 6 and 9 of Order EHA/2899/2011, of 28 October.
