How are claims processed?
The procedure followed after a claim is presented is as follows:
- A file is opened for every claim.
- The proceedings begin with the documentation submitted by the claimant.
- If the documentation submitted is incomplete, the claimant will be requested to complete it within a period of 10 working days, otherwise the claim will be considered as discontinued.
-
Once the claim submitted is complete and valid, the institution has 15 working days to submit its
allegations
.
- Once the allegations have been received, the claim is assessed.
-
The procedure is interrupted if the institution in the claim accepts the claimant's allegations or if the claimant voluntarily
discontinues
the claim.
-
Claims conclude with the Claims Service issuing a
justified report which in no case shall be considered as an appealable administrative ruling
.
- If the report were unfavourable for the institution in the claim, the institution would have to notify the Claims Service of whether the voluntary rectification has been made within a period of no more than one month from the date it was reported.
