Banking Supervision

Basic regulation

The regulation and supervision work carried out by the Banco de España aims to promote solid and secure institutions, to minimise systemic risks, to protect depositors and to ensure there is competitive equilibrium and efficiency.

This section covers the basic regulation that supervised institutions are subject to, such as credit institutions' accounting regulations and prudential standards or the requirements to be able to provide banking services in Spain. In particular, it provides information on current regulations, guidelines, general notifications and relevant data issued by the Banco de España.

Differentiation is made between the regulations applicable to credit institutions and the specific legislation that regulates a diverse set of institutions called financial auxiliaries, whose business consists of providing guarantees (mutual guarantee companies), performing valuations to offer security to the mortgage market (valuation companies), providing payment services (payment institutions) and offering foreign currency exchange services (foreign-exchange establishments).

Lastly, the following subsections do not include certain legal provisions which likewise govern the activities of credit institutions, such as those concerning the prevention of money laundering or the regulation of securities markets. These regulations can be consulted through the links provided to the Directorate General of the Treasury and Financial Policy, the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Offences (SEPBLAC), the National Securities Market Commission (CNMV) or the Directorate General of Insurance and Pension Funds.
